1000 Promotion - Official Rules

Promotion Description. The 1000 Promotion (the "Promotion") is a sweepstakes promotion by Quickgigs, Inc. a Minnesota company ("Quickgigs") in which entrants purchasing Immutation through quickgigs.com or following the free alternative will be eligible to win one (1) iPhone (8GB model) (total approx. retail value: U.S. $599.00) or a quantity of iPods not to exceed $599.00 in retail value (the "Prize"):

How To Enter. You will automatically be entered into the Promotion by: 1) purchasing a copy of Immutation; or 2) send a postcard with a hand printed name, postal address, and e-mail address to Quickgigs - Promotion P.O. Box 27512 Golden Valley MN 55427. Mechanically produced entries are ineligble. To protect your privacy, a letter with an enclosed paper containing a hand printed name, postal address, and e-mail address will also be considered valid. The Promotion begins following the purchasing of the 1st copy of Immutation, and ends with the purchasing of the 1,000th copy ("End Date"). All eligible mail entries will be accepted that on End Date or before. Only Entries submitted in this time period will be accepted. Only one entry per person is allowed. Quickgigs is the sole determiner of valid Entries. Quickgigs reserves the right to add valid methods of Entry.

Eligibility. In order to be eligible, entrants must be 13 years of age or older, and a legal resident of one of the 50 United States, including Washington, D.C. or other countries where the promotion is legal and Quickgigs is allowed to ship the Prize. Quickgigs is the sole determiner of if the Prize can be awarded to Entries in a country. Entrants under 18 should obtain a parent's or guardian's consent before participating. Entry can only be made by individual consumers. Organizations and businesses are not eligible. No owner, employee, or consultant of Quickgigs is eligible. No family member (defined by parents and siblings) of an owner, employee, or consultant of Quickgigs is eligible. To participate, entrants must: 1) have a computer with Immutation installed (Immutation is available at: http://www.quickgigs.com/) or mail an eligible Entry, 2) Internet access and an Internet accessible e-mail account and 3) submit an Entry.

How You Win. Winners will be determined by a random drawing of all Entries after the 1,000th copy of Immutation is sold. Each entrant's chances of winning are dependent upon the number of Entries received. Quickgigs will notify the winner by e-mail and/or by post at the address provided within approximately three (5) days following selection of the winner. Quickgigs is not responsible for any delay or failure to receive notification for any reason, including inactive e-mail account(s), technical difficulties associated therewith, or winner's failure to adequately monitor any e-mail account or physical address. The winner must then respond to Quickgigs within ten (10) days. Should the winner fail to respond to Quickgigs, Quickgigs reserves the right to select new, replacement winners until a winner fulfills the above requirements. The replacement winner will also be selected by random drawing. The winner will only be listed on http://www.quickgigs.com if the winner agrees (we will protect the winner's privacy). A copy of the receipt with sensitive information (e.g. credit card numbers) for the Prize will be available by sending a self-addressed stamped envelope to Quickgigs - Promotion Winner P.O. Box 27512 Golden Valley MN 55427.

Taxes. All taxes associated with the receipt or use of the prizes are the sole responsibility of each winner. Quickgigs reserves the right to withhold any taxes as required by applicable law. The Prize will be awarded and is not transferable. No substitutions (including for cash) are permitted, but Quickgigs reserves the right to substitute a Prize of equal or greater monetary value to the prizes if for any reason the prize cannot be awarded as contemplated in these rules. One example is the release of new models that replace the current model before the contest is over.

Conditions of Participation. By submitting an Entry for this Promotion, you agree to abide by these rules and any decision Quickgigs makes regarding this Promotion. Quickgigs reserves the right to disqualify from the Promotion, and any future contest or other promotion conducted by Quickgigs, and to take such other action as may be appropriate, any entrant or winner who, in Quickgigs's reasonable suspicion, tampers with Quickgigs's web site, the entry process, intentionally submits mechanical entries, violates these rules or laws of the United States or Minnesota, or acts in an unsportsmanlike or disruptive manner.

Disclaimer and Limitation of Liability. QUICKGIGS IS NOT RESPONSIBLE FOR ANY SERVICE CONTRACTS, FEES, OR OTHER EXPENSES RELATED TO USE OR OWNERSHIP OF THE PRIZE. QUICKGIGS MAKES AND GIVES NO REPRESENTATIONS, CONDITIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE PROMOTION OR ANY PRIZE OR ANY ENTRANT'S PARTICIPATION IN THE PROMOTION. QUICKGIGS SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY LOSS, DAMAGE, COST, OR INJURY THAT ARISES FROM, ANY OCCURRENCE, EVENT OR CONDITION OUTSIDE QUICKGIGS'S REASONABLE CONTROL THAT MAY AFFECT THE PROMOTION OR CAUSE THE PROMOTION TO BE DISRUPTED, SUSPENDED OR CORRUPTED, INCLUDING: (I) FAILURE TO SELL 1,000 COPIES OF IMMUTATION (II) LATE, LOST, DELAYED, DAMAGED, MISDIRECTED, INCOMPLETE, OR UNINTELLIGIBLE ENTRIES; (III) TELEPHONE, ELECTRONIC, HARDWARE OR SOFTWARE PROGRAM, NETWORK, INTERNET, OR COMPUTER MALFUNCTIONS, FAILURES, VIRUSES OR DIFFICULTIES OF ANY KIND; (IV) FAILED, INCOMPLETE, GARBLED, OR DELAYED COMPUTER TRANSMISSIONS; AND (V) THE DOWNLOADING OF ANY MATERIAL IN CONNECTION WITH THIS PROMOTION. QUICKGIGS RESERVES THE RIGHT, IN ITS SOLE DISCRETION AND WITHOUT PRIOR NOTICE, TO SUSPEND OR CANCEL THE PROMOTION OR ALTER THE RULES IF AT ANY TIME A COMPUTER VIRUS, TECHNICAL PROBLEM, OR OTHER UNFORESEEABLE OCCURRENCE, EVENT OR CONDITION ALTERS OR CORRUPTS THE ADMINISTRATION OF THE PROMOTION.

Release. BY ENTERING THE PROMOTION, EACH ENTRANT RELEASES AND AGREES TO HOLD HARMLESS QUICKGIGS, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS FROM ANY LIABILITY WHATSOEVER FOR ANY CLAIMS, COSTS, LOSSES OR DAMAGES OF ANY KIND (INCLUDING, WITHOUT LIMITATION, THOSE RELATED TO PERSONAL INJURY, DEATH, DAMAGE TO PROPERTY, INFRINGEMENT OF PROPRIETARY RIGHTS, RIGHTS OF PUBLICITY OR PRIVACY OR DEFAMATION), ARISING OUT OF OR IN CONNECTION WITH: (I) ENTERING THE PROMOTION; (II) ACCEPTANCE OR USE OF ANY PRIZE; OR (III) OTHERWISE ARISING OUT OF OR RELATING TO THE PROMOTION.

Privacy and Use of Promotion Information. Any personal information received by Quickgigs in connection with this Promotion will be used solely at the discretion of Quickgigs. Quickgigs will not publish the winner's name unless the winner gives permission. Quickgigs will file the winner's name and personal information with appropriate government agencies as required by law.

Governing Law. These Rules and this Promotion are governed by and controlled by the laws of the State of Minnesota, applicable to contracts made and performed therein without reference to the applicable choice of law provisions. All actions, proceedings or litigation relating hereto will be instituted and prosecuted solely within the State of Minnesota, Hennepin County. The parties consent to the jurisdiction of the state courts of Minnesota and the federal courts located with such state and county with respect to any action, dispute or other matter pertaining to or arising out of this Promotion. This Promotion is subject to all applicable laws. Void where prohibited.
